These terms explain the rules for using Learn Anesthesia with D.A.N and its courses, question banks, mock examinations, explanations and study tools.

1. Agreement and platform operator

These Terms of Use form an agreement between you and Dr. Ahmed Naeem, trading as Learn Anesthesia with DAN (“Learn Anesthesia”, “we”, “us” or “our”), in relation to learnanesthesia.online and the educational services made available through it (the “Platform”).

By creating an account, starting a trial, purchasing access, or using the Platform, you confirm that you have read and accepted these terms. If you do not agree, do not create an account, make a payment, or use restricted Platform content.

2. Eligibility, registration and account security

• The Platform is intended for medical students, doctors and other healthcare learners using it for lawful educational purposes.
• You must provide accurate registration and payment-verification information and keep your registered email address current.
• Each account is personal to one user. You must not sell, lend, share, transfer or allow another person to use your account.
• You are responsible for protecting your password and for activity performed through your account. Notify us promptly if you suspect unauthorised access.
• We may use proportionate security checks—such as login, device and access-pattern review—to investigate suspected account sharing, automated access or misuse. A legitimate change of device or location will not by itself be treated as a breach.

3. Educational service and medical disclaimer

The Platform provides educational questions, explanations, revision notes, performance information and examination-practice tools. Content is prepared for learning and assessment practice only.

Platform content must not be used as a substitute for professional clinical judgment, local protocols, current guidelines, supervision, or patient-specific assessment. Medical knowledge and examination standards change. Although we aim to review and correct content, we do not promise that every item will always be complete, current or error-free.

Learn Anesthesia is independent. Unless a page expressly states otherwise, it is not affiliated with, endorsed by, sponsored by, or acting on behalf of the College of Physicians and Surgeons Pakistan, any university, hospital, regulator, examination board, or professional association.

References to past examinations or “recalls” describe independently reconstructed educational material based on reported themes. They are not represented as official, verbatim, authorised or complete examination papers.

4. Trials, payments and subscriptions

• The scope and duration of a free trial are those displayed for the relevant offer when you enrol. Trial access may differ by course or campaign.
• Paid access begins when we verify payment and activate the selected subscription. The confirmation message should state the plan, activation date and expiry date.
• The price, included courses and access period shown before payment form part of your purchase. You are responsible for checking these details and using the same registered email address for payment verification.
• Subscriptions do not renew automatically unless automatic renewal is clearly offered and accepted. The current manual bank-transfer and mobile-wallet process does not itself create automatic renewal.
• Access expires at the end of the purchased period unless renewed. Quiz history may remain in your account subject to the Privacy Policy, but expired restricted content will no longer be available.
• Refunds are handled under the Refund Policy. Nothing in these terms removes a remedy or right that applicable law does not permit us to exclude.

5. Acceptable use

You may use the Platform for your own non-commercial study. You must not:

• share an account or permit access by another person;
• copy, photograph, screen-record, republish, sell, distribute or publicly display substantial parts of the question bank, explanations or course materials;
• scrape, crawl, bulk-download, export, automate access to, or systematically extract Platform content;
• upload Platform content to another question bank, commercial product, public group, file-sharing service, generative-AI training collection or similar repository;
• bypass access controls, interfere with security, probe for vulnerabilities, introduce malicious code, or disrupt the Platform;
• impersonate another person, submit false payment evidence, manipulate results, or use the Platform unlawfully; or
• harass others or submit unlawful, infringing or abusive material through support, feedback or reporting tools.

You may make reasonable personal study notes in your own words. Such permission does not allow reproduction of entire questions, answer sets, explanations, images or substantial collections.

6. Intellectual property

Ownership and permitted use of Platform materials are explained in the Intellectual-Property Notice. Your subscription purchases time-limited access to the service; it does not transfer ownership of course content or grant a right to redistribute it.

If you submit a correction, suggestion or other feedback, you allow us to review, edit and use that feedback to operate and improve the Platform. You retain ownership of any original material you submit, subject to this limited permission.

7. Platform availability and changes

We aim to provide reliable access but cannot promise uninterrupted or error-free service. Maintenance, hosting incidents, security events, network failures and circumstances outside our reasonable control may temporarily affect availability.

We may correct questions, update explanations, change course organisation, retire obsolete material, and improve features. We will not materially reduce an active paid subscription without a reasonable substitute, extension, partial refund or other appropriate remedy where required.

We may update these terms. Moodle will request renewed consent where a change is material. Minor corrections that do not change your rights or obligations may be recorded without renewed consent.

8. Suspension and termination

We may temporarily restrict an account while investigating a security, payment or acceptable-use concern. Where reasonably possible, we will explain the concern and allow the user to respond.

We may suspend or terminate access for a material or repeated breach, fraud, unlawful activity, account sharing, security interference or unauthorised distribution of content. Any refund decision will follow the Refund Policy and applicable law. We will not use this clause to avoid a remedy for a defective service.

You may stop using the Platform at any time and may request account deletion under the Privacy Policy. Ending or deleting an account does not automatically create a refund entitlement.

9. Responsibility and liability

You remain responsible for your study decisions, examination registration, clinical decisions, device, internet connection and compliance with your institution's rules.

To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential loss, loss of examination opportunity, expected marks, employment opportunity or clinical outcome arising from reliance on educational content or circumstances outside our reasonable control.

Nothing in these terms excludes or limits liability, consumer remedies or other rights that cannot lawfully be excluded or limited.

10. Governing law, complaints and contact

These terms are governed by the applicable laws of Pakistan. Courts or consumer forums with lawful jurisdiction may hear a dispute. Before formal proceedings, we encourage you to contact us so that we can try to resolve the matter promptly and fairly.

Refund Policy

Payments and subscriptions

This policy explains when a payment may be refunded, how to request a review, and what information we need to resolve the request.

1. Scope

This policy applies to paid digital subscriptions for Learn Anesthesia with D.A.N. Access is normally activated manually after your payment and registered email address are verified.

A free trial does not involve a payment and therefore has no refundable amount. Ending a free trial does not create a credit or cash entitlement.

2. Cases normally eligible for a full refund

• Duplicate payment: the same subscription was paid more than once.
• Overpayment: you transferred more than the clearly stated price. We may return the excess or, with your agreement, apply it to an upgrade.
• Payment received but access not activated: we cannot provide the purchased access and you do not accept a reasonable alternative.
• Withdrawal before activation: you ask us to cancel before paid access has been activated.
• Material service failure: the purchased service is materially unavailable because of a problem within our control and we cannot restore access, provide a reasonable extension, or offer an equivalent remedy.

3. Accidental purchase review

We will review an accidental purchase request when it is submitted within 48 hours of activation and the account has not made substantive use of paid content. Relevant facts may include whether a restricted quiz was attempted or submitted, a mock examination was started, or paid materials were downloaded or systematically accessed.

This review is intended to resolve genuine mistakes fairly. It is not a promise of a refund after paid digital content has been substantially accessed. Any right or remedy required by applicable law remains available regardless of these criteria.

4. Cases not normally eligible

A refund is not normally provided solely because:

• you changed your mind after substantially using paid content;
• you did not use the subscription before it expired;
• your examination date, personal schedule, employment or training circumstances changed;
• you did not achieve a desired score or examination result;
• your own device, browser, internet connection or institutional network prevented access when the Platform was otherwise available;
• you sent an incorrect registered email address and did not allow a reasonable opportunity to correct it; or
• access was restricted following verified fraud, payment manipulation, account sharing, content redistribution or another material breach of the Terms of Use.

These exclusions do not apply where the service was faulty, materially misdescribed, not supplied as agreed, or where applicable law requires a remedy.

5. Extensions and partial refunds

For a temporary disruption, a fair extension of the subscription may be more useful than a refund. Where only part of the purchased service was affected, we may offer a proportional refund, account credit, replacement access or extension. We will explain the proposed remedy and will not use this section to remove a non-excludable legal right.

6. How to request a refund

Email admin@learnanesthesia.online or message WhatsApp support. Use the subject Refund request – registered email and provide:

• your full name and registered Moodle email address;
• the subscription plan and amount paid;
• payment date, method and transaction/reference number;
• a clear screenshot or receipt, with unrelated sensitive details hidden;
• the reason for the request; and
• the account details needed to return a manual transfer, if requested.

Please submit the request promptly—normally within seven calendar days of activation or of discovering the issue. A delayed request will still be considered where applicable law requires it or there is a reasonable explanation.

7. Review and processing

• We aim to acknowledge a complete request within two business days.
• We may verify payment, activation and relevant Moodle access records before deciding the request.
• We aim to communicate a decision within seven business days after receiving the required information.
• An approved refund is normally sent within seven to fourteen business days. Bank or wallet processing times may add further delay.
• The refund will normally use the original payment route or a verified account belonging to the payer. We will never ask for a banking password, PIN or one-time code.

8. Chargebacks and unresolved complaints

Please contact us before initiating a payment dispute so that we can investigate activation, duplication or service problems. This does not prevent you from using any lawful complaint, banking or consumer-remedy process.

Intellectual Property Notice

Content protection and permitted use

This notice explains what you may do with Learn Anesthesia content, what is prohibited, and how third-party rights and reconstructed examination material are handled.

1. Platform-owned material

Subject to third-party rights and the exclusions below, original Platform materials are owned by or licensed to Dr. Ahmed Naeem trading as Learn Anesthesia with DAN. These materials may include:

• original question wording, answer options and explanations;
• the original selection, organisation, tagging and presentation of question-bank content;
• course notes, diagrams, graphics, banners and educational layouts;
• editorial commentary, clinical pearls and performance resources; and
• Learn Anesthesia names, logos and original visual identity, where protected.

Copyright does not create ownership over medical facts, ideas, procedures, public-domain material or third-party works. This notice does not claim rights beyond those legally held by the Platform operator or its licensors.

2. Your personal study licence

While your access is active and you comply with the Terms of Use, you receive a limited, revocable, non-exclusive, non-transferable licence to:

• view and answer questions through your own account;
• read explanations and permitted course materials;
• use your own performance information for personal study; and
• make reasonable private notes in your own words for your personal, non-commercial revision.

This licence ends when access expires or is lawfully terminated. Your own original notes remain yours, but copied Platform content within those notes remains subject to applicable rights and restrictions.

3. Uses that require written permission

Unless the law expressly permits the use, you must not:

• copy, photograph, screen-record, reproduce or distribute complete questions, answer sets, explanations, images or substantial collections;
• post Platform content in WhatsApp, Telegram, Facebook, email, forums, shared drives, websites, lectures, coaching groups or other services;
• sell, sublicense, translate, adapt, publish or commercially exploit Platform content;
• use content to create, populate, benchmark or improve another question bank, course, book, application, dataset or commercial service;
• scrape, bulk-extract, automate collection or upload Platform content for training, evaluating or supplying a generative-AI or machine-learning system;
• remove watermarks, copyright notices, source acknowledgements or access controls; or
• use the Learn Anesthesia name or logo in a way that suggests endorsement, partnership or official status.

4. Past-paper recalls and examination references

Material described as a “recall”, “past-paper recall” or similar term is an independent educational reconstruction based on reported topics or remembered themes. It may be incomplete, paraphrased, corrected, expanded or reorganised for teaching.

Such material is not represented as an official, verbatim or authorised copy of a confidential examination paper. Users must not submit material obtained through unlawful conduct or in breach of an examination body's confidentiality rules.

Names of examinations, colleges, institutions and professional bodies may be used descriptively. Their names and marks belong to their respective owners. No affiliation or endorsement is implied.

5. Open-source software and third-party content

The Platform uses Moodle and may use themes, plugins, fonts, icons, references and other third-party materials. Those components remain governed by their respective licences and rights. Nothing in this notice changes an open-source licence or claims ownership of third-party work.

Short quotations, citations and referenced guidelines are attributed where appropriate. A link or citation does not imply that the third party endorses the Platform.

6. Student submissions and feedback

You retain ownership of original feedback, correction suggestions and other lawful material you submit. By submitting it, you grant us a worldwide, royalty-free permission to review, reproduce, edit and use it as reasonably necessary to operate, secure and improve the Platform.

Do not submit patient-identifiable information, confidential examination material, or content that you do not have permission to share.

7. Reporting an intellectual-property concern

If you believe Platform content infringes your rights, email admin@learnanesthesia.online with:

• your name and contact details;
• identification of the protected work or mark;
• the exact Platform URL and description of the material concerned;
• the basis of your rights or authority to act for the rights holder; and
• a good-faith statement that the disputed use is not authorised.

We will review sufficiently detailed notices, may temporarily restrict disputed content during review, and may request further information. Knowingly false or abusive notices may themselves violate the Terms of Use.

8. Suspected unauthorised sharing

Please report suspected resale, public posting, scraping or unauthorised distribution to admin@learnanesthesia.online. Include a link or screenshot and enough context to investigate. Do not obtain evidence through unlawful access.
